On 1st October 2010 the Health and Social Care Act 2008 came into force for adult social care providers, including care homes and domiciliary care services. There are increased penalties for failure to comply with the Regulations, for example, in cases of neglect, including prosecution, fines of up to £50,000 and cancellation of registration.
Under Regulation 14 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2010, where food and hydration are provided as part of the regulated activity, the registered person must ensure that service users are protected from the risks of inadequate nutrition and dehydration.
